The company PANNTOUR Andrej Jakolič sp, with its head office at Krčevina pri Ptuju 71A, 2250 Ptuj, registration number 8244359000, tax number: 15703363, hereinafter referred to as "PANNTOUR", in order to protect the privacy of individuals of its services ("customers") and other persons whose data it processes (hereinafter collectively: "individuals"), with these Data Protection Terms in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC and the Personal Data Protection Act (as amended) describes the personal data protection policy, states the types, duration of storage, purpose and rights of individuals in relation to personal data and their processing, and thereby supplements Terms of business Paradiznik.si. These Terms apply to all cases where PANNTOUR acts as a controller of individuals' personal data.
PANNTOUR processes the personal data of individuals on the basis of law, contract, legitimate interest and/or on the basis of the individual's voluntary consent.
PANNTOUR processes the following data about customers for the purpose of providing services: name and surname for natural persons/company and organizational form for legal entities, address/registered office of the individual and contact telephone number, at the request of the individual, academic, scientific or professional title, address of their website and other types of their personal contacts, email address, tax number for natural persons and tax and registration number for legal entities, address for sending invoices, if different from the permanent one (street or settlement - number, postal code, city), transaction account number for individuals, additional data based on the customer's payment, if the individual so wishes and this does not infringe on the rights of third parties.
PANNTOUR will process and store the personal data specified in the previous paragraph until full payment for the services. If required by tax legislation, some data will be stored until the 10-year retention period has expired.
Based on the explicit consent of individuals, PANNTOUR collects, stores, uses and segments the name and surname, address, contact email address, contact telephone number, customer number, traffic data, location data that are not traffic data, for the purpose of (i) targeted notification of offers and benefits for potential new services, but not longer than 10 years, via SMS and MMS messages, email, mail, telephone; and/or (ii) notification of prize competitions organized by PANNTOUR or its partner companies in cooperation with PANNTOUR, via SMS and MMS messages, email, mail, telephone; and/or (iii) surveys regarding customer satisfaction and additional PANNTOUR services via SMS and MMS messages, email, mail, telephone. PANNTOUR stores and uses the personal data specified in this paragraph for as long as necessary to achieve the purpose for which the data was processed or until the individual withdraws their consent.
It is in PANNTOUR's legitimate interest to use individuals' personal data to improve, adapt, modify, personalize or otherwise enhance its services, to detect and prevent fraud, to improve website security, to send messages that will benefit the individual, and to analyze the effectiveness of marketing communication.
PANNTOUR may, if necessary for the performance of PANNTOUR's contractual obligations, transfer the personal data of individuals to external service providers and suppliers of goods, including PANNTOUR's affiliated companies. Third parties have concluded an appropriate personal data processing agreement with PANNTOUR.
This article summarizes the rights that individuals have in relation to the processor and are determined by applicable law and these Terms. Some of the rights include specific features that are not included in this summary and are found in the Basic Legal Bases. An individual has, under the conditions determined by applicable law and these Terms, the right to (a) access to personal data; (b) rectification of personal data, (c) erasure, (d) restriction of processing, (e) objection to processing for a specific purpose, (f) portability, (g) complaint to a supervisory authority, (h) withdrawal of consent to processing.
Insight
The individual has the right to confirm whether or not personal data are being processed and, where personal data are being processed, to obtain access to the personal data, together with certain additional information. The additional information includes details of the purpose of the processing, the categories of personal data being processed and the recipients of the personal data. Unless this affects the rights and freedoms of third parties, PANNTOUR will provide the individual with a copy of their personal data.
Correction
The individual has the right to have inaccurate personal data corrected and, if appropriate for the purpose of the processing, to have incomplete data completed.
Deletion
In certain circumstances, an individual has the right to have personal data erased without undue delay, namely where (i) the personal data are no longer necessary for the purposes for which they were collected or are otherwise processed; (ii) the individual withdraws consent to the processing of personal data for data processed on the basis of consent; (iii) the individual objects to the processing of personal data for direct marketing purposes based on the legitimate interest of the processor; (iv) if the processing of personal data is without appropriate grounds. Regardless of the request for erasure, PANNTOUR is not obliged to erase personal data if the processing of such personal data is necessary for the exercise of the right to freedom of expression and receipt of information, to ensure compliance with legal obligations, or where the processing is necessary for the establishment, exercise or defence of legal claims.
Restriction of processing
The individual has the right to restrict the processing of personal data for data (i) for which he/she exercises the right to rectification, (ii) which is processed without a proper basis, but the individual does not request deletion of them, (iii) if PANNTOUR does not process the personal data for the purposes specified in Article 2, but the individual needs such data for the establishment, exercise or defense of legal claims. In the above cases, PANNTOUR will store the personal data, but will not process them otherwise, except in the case of explicit consent or for purposes where the processing is necessary for the establishment, exercise or defense of legal claims or the protection of the rights of a third natural or legal person or for reasons of overriding public interest.
Objection to processing
The individual has the right to object to the processing of personal data for reasons relating to the individual's particular circumstances, but only if the basis for the processing of personal data is the processing of personal data for the purpose of exercising public interest or exercising public authority or exercising public interest of PANNTOUR or a third party. In the event of a request to object to the processing, PANNTOUR will cease the processing, unless it demonstrates an overriding legitimate interest in the processing which overrides the interests, rights or freedoms of the individual or the purpose of the processing is the establishment, exercise or defence of legal claims. The individual has the right to object to the processing of personal data for the purpose of direct marketing. In such a case, PANNTOUR will immediately cease the processing for such purpose. The individual has the right to object to the processing of personal data for reasons relating to the individual's particular circumstances, including in the case of processing for research, scientific or statistical purposes, except where the processing is necessary for a purpose in the public interest.
Portability of personal data
Where the basis for the processing of personal data is the explicit consent of the individual or the processing is necessary for the performance of contractual obligations between PANNTOUR and the client or the procedure for concluding such a contract is underway, and in all such cases the processing is automated, the individual has the right to receive his or her personal data in a structured, commonly used and machine-readable format. The aforementioned right of the individual does not apply in cases where the exercise of such right would interfere with the rights and freedoms of third parties.
Complaint to the supervisory authority
An individual has the right to file a complaint with the supervisory authority for personal data protection in the EU country where the individual has permanent residence, employment, or to the authority of the country where they allege a violation.
Withdrawal of explicit consent to the processing of personal data
An individual has the right to withdraw his or her consent at any time, where the processing of personal data is based on his or her explicit consent. Withdrawal of consent shall not affect the lawfulness of the processing of personal data prior to its withdrawal, nor shall it affect the validity of the explicit consent for the processing of personal data.
The client, who is a legal entity, sole proprietor or other organization that does business with PANNTOUR on its own behalf and the individual services are a member of such organization or uses the services on the basis of authorization from such organization (hereinafter: “organization”), is obliged to inform all individuals who use PANNTOUR services about these Rules and for what purposes PANNTOUR and its contractual processors will process their personal data upon commencement of business with PANNTOUR. The organization that has concluded a contract with PANNTOUR for the provision of services, and if necessary, is obliged to provide all necessary consents of individuals who use PANNTOUR services and PANNTOUR needs to process personal data in fulfilling the contract. The organization is thus obliged to provide the consent of the individual who uses PANNTOUR services for the client to send certain personal data of the individual to the organization, to process traffic data and location data that are not traffic data and are necessary for the provision of additional services, and all other necessary consents. The organization that is a client of PANNTOUR's services provides PANNTOUR with insight into all individual consents that PANNTOUR needs to process personal data.
