The commission cost is charged according to the current postal price list. To avoid postal commission, we recommend paying &quot;by invoice&quot;. There are no additional costs. In most cases, products are delivered with Po\u0161ta Slovenije, but we reserve the right to choose another delivery service if this will allow the order to be fulfilled more efficiently.<\/p><p>Delivery is completely secure and for all purchases only possible to addresses in Slovenia. Express or personal delivery is only possible in certain cities.<\/p><p>The risk of loss or damage to the goods shipped shall pass from the provider to the buyer when the goods are physically received by the latter or when the goods are physically received by a third party other than the carrier and designated by the consumer for this purpose. If the product is currently out of stock, we will inform the customer about the delivery time.<\/p><p>After receiving your order or payment confirmation (*), we will begin the shipping or preparation activities for your order. You will receive an email when the shipment is ready.<\/p><p><em>* when choosing the payment option to our transaction account, the activities for executing the order will begin after receiving information about the inflow of funds to our transaction account.<\/em><\/p><p>The delivery cost is stated in the announcement for each product and is always displayed for information and added to the online shopping cart, before and when placing the order.<\/p><p>Delivery price list according to purchase value:<\/p><ul><li>Slovenia: \u20ac4.00;<\/li><li>Austria, Czech Republic, Croatia, Hungary, Germany, Slovakia: \u20ac6.60;<\/li><li>Poland, Romania: \u20ac8.00;<\/li><li>Italy: \u20ac10.00;<\/li><li>Belgium, Bulgaria, Luxembourg, Netherlands: \u20ac11.00;<\/li><li>France: \u20ac15.00;<\/li><li>over \u20ac50.00, delivery costs are covered by the provider.<\/li><\/ul><p><br \/>Delivery is made during the week and on Saturday mornings until 12:00 noon to the address you enter when placing the order.<\/p><p>If you are not at home at the time of delivery, the courier\/delivery service will leave a message, based on which you will arrange for redelivery or collection at the nearest collection unit.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1f691b3 elementor-widget elementor-widget-heading\" data-id=\"1f691b3\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">7. Guarantee of conformity of goods<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1068cf5 elementor-widget elementor-widget-text-editor\" data-id=\"1068cf5\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The provider is liable for any lack of conformity of the goods that exists at the time of delivery of the goods and that becomes apparent within two years of delivery of the goods. It is presumed that the lack of conformity of the goods already existed at the time of delivery if it becomes apparent within one year of delivery of the goods, unless the provider proves otherwise or if this presumption is incompatible with the nature of the goods or the nature of the lack of conformity. The consumer may exercise his rights under the guarantee of conformity if he notifies the provider of the lack of conformity within two (2) months of the discovery of the lack of conformity. In the notice of non-conformity, the consumer must describe the non-conformity in detail and allow the provider to inspect the goods. The notice of non-conformity must be accompanied by an invoice, contract or other document confirming the purchase. The consumer can submit the notice of non-conformity to <a href=\"mailto:info@paradiznik.si\">info@paradiznik.si<\/a>, or hand it in person at the address: PANNTOUR Andrej Jakoli\u010d sp, Kr\u010devina pri Ptuju 71A, Ptuj, 2250 Ptuj.<\/p><p>The goods are in conformity with the sales contract in particular where appropriate (subjective requirements for conformity of the goods):<\/p><ul><li>corresponds to the description, type, quantity and quality and has the functionality, compatibility, interoperability and other properties as required in the sales contract;<\/li><li>it is suitable for the specific purpose for which the consumer needs it and which the consumer informed the provider of at least upon conclusion of the sales contract, and the provider agreed to it;<\/li><li>is delivered together with all accessories and instructions as specified in the sales contract, and<\/li><li>is updated as specified in the sales contract.<\/li><\/ul><p><br \/>In addition to meeting the requirements from the previous paragraph (subjective requirements for conformity of goods), the goods must also (objective requirements for conformity of goods):<\/p><ul><li>be fit for the purposes for which goods of the same type are normally used, taking into account, where appropriate, other regulations, technical standards or, in the absence of such technical standards, industry codes of conduct applicable to the sector;<\/li><li>be of such quality and correspond to the description of the sample or model made available to the consumer by the provider prior to the conclusion of the sales contract, where appropriate;<\/li><li>be supplied with such accessories, including packaging and instructions, as the consumer can reasonably expect to receive, where appropriate, and<\/li><li>be of such quantity and have such characteristics and other properties, including those relating to durability, functionality, compatibility and safety, as are usual for goods of the same type and which the consumer can reasonably expect, having regard to the nature of the goods and taking into account any public statement made in advertising or labelling by or on behalf of the supplier or other persons in the preceding links of the contractual chain, including the manufacturer, unless the supplier proves that:<ul><li>he was not aware of the public statement and could not reasonably be expected to be aware of it,<\/li><li>the public statement was corrected in the same or comparable manner as it was made prior to the conclusion of the sales contract, or<\/li><li>the public statement could not influence the decision to purchase the goods.<\/li><\/ul><\/li><\/ul><p><br \/>The provider is not liable for non-conformity of the goods if the consumer was specifically informed at the time of conclusion of the contract that an individual property of the goods deviates from the objective requirements for conformity as set out in the applicable consumer protection legislation, and the consumer expressly and separately accepted this deviation at the time of conclusion of the contract.<\/p><p>The consumer may require the supplier to bring the goods into conformity free of charge and without significant inconvenience to the consumer, within a reasonable period of time from the moment he informed the supplier of the lack of conformity, which shall not exceed 30 days, taking into account in particular the nature of the goods and the purpose for which the consumer needs the goods. The period may be extended for the shortest time necessary to complete the repair or replacement, but not longer than 15 days, and the supplier shall inform the consumer of the number of days for which the period may be extended and the reasons for its extension before the expiry of the 30-day period.<\/p><p>A consumer who properly informs the provider of the lack of conformity may, in the following order, request the provider to:<\/p><ol><li>free restoration of conformity of the goods (repair or replacement);<\/li><li>reduction of the purchase price in proportion to the non-conformity or withdrawal from the sales contract and request a refund of the amount paid.<\/li><\/ol><p><br \/>If the existence of non-conformity of the goods is disputed, the provider shall notify the consumer thereof in writing within eight days of receiving the consumer&#039;s warranty claim.<\/p><p>If the lack of conformity has occurred within less than 30 days of the delivery of the goods, the consumer may withdraw from the contract. Withdrawal from the contract may be made by means of a statement attached to these terms and conditions. When the consumer withdraws from the sales contract, the provider shall refund the amount paid to the consumer immediately, but no later than eight days after receipt of the goods or proof that the consumer has sent the goods back. The purchase price shall be refunded to the consumer in the same way as the consumer made the payment.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-11e749e elementor-widget elementor-widget-heading\" data-id=\"11e749e\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">8. Product return<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-004dc06 elementor-widget elementor-widget-text-editor\" data-id=\"004dc06\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In the case of distance contracts, the consumer has the right to notify the company of his withdrawal from the contract within 14 days of receipt of the goods, without having to give a reason for his decision. The consumer must return the goods within 14 days of the notification of his intention to withdraw from the contract. The only cost borne by the consumer in connection with the withdrawal from the contract is the direct cost of returning the goods.<\/p><p>In the case of a sales contract, the withdrawal period referred to in the previous paragraph begins to run on the day when:<\/p><ul><li>the consumer or a third party other than the carrier and designated by the consumer acquires actual possession of the goods,<\/li><li>the consumer or a third party other than the carrier and designated by the consumer acquires actual possession of the last item of goods if the subject of the contract is several items of goods ordered by the consumer in one order,<\/li><li>the consumer or a third party other than the carrier and designated by the consumer acquires actual possession of the last shipment or piece of goods, if the delivery of goods consists of several shipments or pieces,<\/li><li>The consumer or a third party other than the carrier and designated by the consumer acquires actual possession of the first item of goods if the delivery of the goods is regular within a certain period.<\/li><\/ul><p>In the case of a service contract, the withdrawal period referred to in the first paragraph of this article begins to run on the date of conclusion of the contract.<\/p><p>In contracts for the supply of water, gas or electricity, if these are not sold in a limited volume or a certain quantity, district heating or digital content that is not recorded on a tangible medium, the withdrawal period referred to in the first paragraph of this Article shall begin to run on the date of conclusion of the contract.<\/p><p>Unless the contracting parties have agreed otherwise, the consumer does not have the right to withdraw from the contract referred to in the first paragraph of this article in the following contracts:<\/p><ul><li>on goods or services whose price depends on market fluctuations over which the company has no influence and which may occur during the withdrawal period;<\/li><li>about goods that are manufactured according to the consumer&#039;s precise instructions and adapted to his personal needs;<\/li><li>on goods that are perishable or have a short shelf life;<\/li><li>on the provision of services, if the company fully fulfills the contract and the provision of the service began on the basis of the consumer&#039;s express prior consent and with the consent that he loses the right to withdraw from the contract when the company fully fulfills it;<\/li><li>on the supply of sealed audio or video recordings and computer programs, if the consumer has opened the security seal after delivery;<\/li><li>on the supply of newspapers, periodicals or magazines, except for subscription contracts for the supply of such publications;<\/li><li>on the delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons, if the consumer has opened the seal after delivery;<\/li><li>on the supply of goods which, due to their nature, are inseparably mixed with other items;<\/li><li>on the supply of alcoholic beverages, the price of which is agreed upon at the time of conclusion of the sales contract and which can be delivered after 30 days, and their actual value depends on market fluctuations over which the company has no influence;<\/li><li>concluded at public auctions;<\/li><li>where the consumer has explicitly requested a home visit by the business to carry out an urgent repair or maintenance. If, during such a visit, the business performs additional services that the consumer has not explicitly requested, or delivers goods that are not spare parts necessary for maintenance or repair, the consumer has the right to withdraw from the contract for those additional services and goods;<\/li><li>on accommodation not intended for permanent residence, transport of goods, vehicle rental, food preparation and delivery, or leisure services where the company undertakes to fulfil its obligation on a specific date or within a specific period;<\/li><li>on the supply of digital content that is not delivered on a tangible data carrier, if the provision of the service has begun on the basis of the consumer&#039;s express prior consent and with the consent that he thereby loses the right to withdraw from the contract.<\/li><\/ul><p><strong><br \/>How do I return a product?<\/strong><\/p><p>Send us an email at <a href=\"mailto:info@paradiznik.si\">info@paradiznik.si<\/a>, write &quot;Return [order number]&quot; in the subject line.<\/p><p>Fill out the returns document and attach it to the shipment along with a copy of the invoice. The document can be found <strong><a href=\"https:\/\/paradiznik.si\/wp-content\/uploads\/obrazec-za-odstop-od-pogodbe.pdf\" target=\"_blank\" rel=\"noopener\">HERE<\/a><\/strong>.<\/p><p>The returned product must be unused, undamaged and in the same quantity. The product must also be returned in its original packaging with all manuals and warranty. A copy of the invoice should also be included with the return.<\/p><p>In the event of withdrawal from the contract, the company shall immediately or no later than 14 days after receiving the notice of withdrawal from the contract, return all payments received.<\/p><p>The company returns the received payments to the consumer using the same payment method as the consumer used, unless the consumer has explicitly requested the use of another payment method and the consumer does not incur any costs as a result.<\/p><p>In sales contracts, the company may withhold the refund of payments received until the returned goods have been received or until the consumer provides proof that he has sent the goods back, unless the company offers the option of collecting the returned goods himself.<\/p><p>When returning a product, the provider does not cover the shipping costs, but the consumer. Except in cases where the provider is responsible for the error. We also do not accept packages with a ransom.<\/p><p>If the goods cannot be returned by post according to the price list with the contractual partner for the provision of transport services, we will charge the costs of returning the goods.
